1. Agreement
These Terms of Use ("Terms") govern your use of the NFTwidge iPhone app, widgets, Live Activities, website, and related application programming interfaces operated by ZXBT LLC ("ZXBT," "NFTwidge," "we," "us," or "our") (together, the "Service"). By using the Service, you agree to these Terms with ZXBT LLC and our Privacy Policy. If you do not agree, do not use the Service.
You must be legally able to enter into this agreement in your location. If you use the Service for an organization, you represent that you have authority to bind that organization.
2. What NFTwidge does
The Service reads public blockchain and NFT metadata associated with a public wallet address and lets you select image-backed artwork for display in the app, compatible Home Screen widgets, and a user-started Live Activity.
- NFTwidge is not a wallet, exchange, marketplace, custodian, or broker.
- The Service does not request private keys or transaction signatures.
- The Service cannot transfer, sell, approve, or otherwise control an NFT.
- NFTwidge does not send artwork to a generative-AI provider. It creates device-local display renditions using proportional scaling and center-cropping; the source asset file and onchain metadata remain unchanged.
- A Dynamic Island display is a time-limited Live Activity session, not a permanent system status. A session lasts no longer than eight hours.
NFTwidge does not host user uploads or user accounts. We may filter or suppress an asset or collection after a report, to enforce these Terms, protect users, or comply with law.
3. Acceptable use
You agree not to:
- Use the Service in violation of law or another person's rights.
- Attempt to gain unauthorized access to the Service, another system, or nonpublic data.
- Interfere with the Service, evade reasonable request limits, scrape it at scale, or impose an unreasonable infrastructure load.
- Introduce malware, probe for vulnerabilities without written authorization, or misuse an error or security issue.
- Misrepresent NFTwidge as evidence of authorship, authenticity, title, or legal ownership.
4. Artwork and intellectual property
You retain whatever rights you already have in content you select. Using a public wallet address or displaying an image does not grant you copyright, trademark, publicity, or other intellectual-property rights in that image.
You are responsible for ensuring that your use and display of artwork complies with the rights and license terms that apply to it. NFTwidge does not determine whether a wallet holder owns copyright or whether a particular display is authorized.
The NFTwidge name, app, website, interface, code, and original brand materials are protected by applicable intellectual-property laws. These Terms give you a limited, revocable, nonexclusive, nontransferable right to use the Service for its intended purpose.
5. Public data and third-party services
Blockchain records, NFT metadata, images, collection labels, and ownership information are supplied by independent networks and third parties. They may be inaccurate, unavailable, changed, removed, or malicious. We do not guarantee provenance, authenticity, ownership, rarity, value, permanence, or legal status.
The Service may depend on Apple platform features, blockchain networks, data providers, naming services, metadata hosts, and content networks. Their terms and availability also apply to your use of those services. NFTwidge is not responsible for third-party systems it does not control.
6. Availability and pricing
NFTwidge version 1 is free. It has no purchases, subscriptions, advertising, or paywall. We may add, remove, limit, or charge for future features. Any paid offering will present its price and terms before you purchase it; NFTwidge will not retroactively charge you merely for having used a free version.
We may change, suspend, or discontinue any part of the Service, including support for a chain, provider, widget family, or operating-system feature. We do not promise that every NFT, image format, device, or system version will be supported.
7. No financial or legal advice
The Service is for display and informational purposes. Nothing in it is financial, investment, tax, legal, or valuation advice. NFT markets and blockchain assets can be volatile and risky. Make independent decisions and consult qualified advisers when appropriate.
8. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and noninfringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that third-party data will remain available.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
9. Limitation of liability
To the maximum extent permitted by law, ZXBT LLC and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, asset access, or business opportunity arising from the Service or third-party data.
To the maximum extent permitted by law, our aggregate liability for claims relating to the Service will not exceed the greater of the amount you paid NFTwidge for the Service during the twelve months before the claim or US $25. Some jurisdictions do not allow certain limitations, so those limitations may not apply to you.
10. Suspension and termination
You may stop using the Service at any time. We may limit or end access when reasonably necessary to protect users or infrastructure, respond to legal requirements, address abuse, or discontinue the Service. Sections that by their nature should survive will remain in effect after termination.
11. General terms
These Terms and the Privacy Policy are the entire agreement concerning the Service unless additional terms are presented for a specific feature. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver.
Applicable law governs these Terms without regard to conflict-of-law rules, subject to any mandatory consumer protections in your jurisdiction. Your use of the iOS app may also be subject to Apple's applicable App Store terms.
12. Open-source software
NFTwidge includes Pow by Emerge Tools under the MIT License. The complete copyright notice and license text are bundled in the app under Open Source Licenses. Third-party open-source components remain governed by their own licenses, and nothing in these Terms limits rights granted by those licenses.
13. Changes and contact
We may update these Terms as the Service changes. We will post the revised Terms and update the effective date. Continued use after an update takes effect means you accept the revised Terms where permitted by law.
